Is Eea3 Mandatory When Partner Is Applying For Eea4?

Hi guys,
Italian national living in the UK since 2008 fully exercising treaty rights and non EEA living in the UK since 2008.
EEA2 approved from May 2009.
Is it obligatory for the European National to apply for EEA3 in order for the non-european to apply for permanent residency (eea4)?

Not mandatory at all. If you have it it might make things easier but there's no requirement.
If you apply for EEA4 directly (and the EEA family member doesn't have EEA3 proof), then the non-EEA family member will have to prove that the EEA citizen has been exercising treaty rights in the UK for the past 5 years. All documentation must be provided.
If they have EEA3, it might be easier as the proof of exercising treaty rights has already been accepted by the Home Office.

Thank you so much for the reply 'chaoclive'.
They received my EEA4 application on 01/05/14 (yesterday) and I didn't include an EEA3 application. However, all the documents since April 2009. I was just a bit concerned if we should have sent the EEA3 as well. One less worry now! Hopefully it will be a swifty approval.
