REMOVAL OF PERSONS FROM UK

Hello, I was living in England and I did a crime. I was sent to prison for 4 months. After 2 weeks officers ask me ''do i want back to my country? and said yes'', I sign deportation papers. So when my sentence over. I been removed from uk and sent back to my country. Im Lithuanian(Europe union). I want to know for how much time I get ban. When I can back to uk. Thank you for answers.

There is no particular ban. It depends on the nature of the crime.

Depends if you're deemed a risk to national security or policy, I would doubt it if it's your only offence.

Under present arrangements non-EEA nationals sentenced to 12 months or more are considered for deportation by the UK Borders Agency if the Court has not already recommended deportation. Prisoners are deported if their presence in the UK is judged not to be ‘conducive to the public good’.

It is Home Office policy to deport EEA nationals and their family members when there is a "custodial sentence of 12 months or more for an offence involving drugs, violent or sexual crimes or a custodial sentence of 24 months or more for other offences". And for minor offences, the Home Office can only deport you if you are likely to still represent a current threat to public policy, so if you have a history of persistent offending up until recently even if for minor crimes then you are likely to be issued with a deportation order. Since I am assuming you don't fall into these categories, you are unlikely to be prevented from re-entry. However if you re-offend it may be a different story.

Thank you for your answers. Its my only crime. How do I know, can i re-entry uk or not. Maybe someone know the website where I can ask?

What was the length of your sentence, and were you issued with a deportation order.

Since you returned to Lituania, have your done work, or anything productive, that can be evidenced?

4 motnhs. They asked me do I want back to my country and I signed deportation documents. If want I can dont sign these papers. I signed with my own will. In lithuania I dont have any job, there is no jobs. I waiting for job in job center. Thank you for your post Obie.

If you were to have a job, I think it would look better. One way that you could find out, is by taking a flight to the UK and seeing what happens when you get to the border.

I don't think that UK will be keen to let people who have committed offenses back in but you may get lucky. You might want to remember that the government will not deal as lightly with a person with a record, i.e. you, the second/subsequent time you offend.

If you left the UK voluntarily and at no public cost, the length of the re-entry ban is one year
If you left the UK voluntarily within six months of exhausting all your appeal rights or being told you would be removed from the UK but at public cost, the ban is for two years
If you left the UK voluntarily more than six months after exhausting your appeal rights or being told you would be removed from the UK and at public cost, the ban is for five years
If you were forcibly removed/deported from the UK, the ban is for ten years
If the Home Office has decided you used deception (and this has not been successfully challenged in court) in your application – whether or not your application was successful – the ban is for ten years

No Valdinis, that relates to those under immigration rules, not those who are EEA nationals.

The length of your sentence indicate that your crime is not a serious one that would attract a re-entry ban, it is highly unlikely that you will have been deported, if you were, it is also unlikely that your deportation order would have complied with regulation 20, 21 or article 27 of the directive. You should be admitted on return.

Re-entry following administrative removal: EEA nationals who are
administratively removed for not exercising Treaty rights (under the current
provisions) will not be able to re-enter the UK for twelve months following
removal unless they can demonstrate that they will immediately be exercising
Treaty rights upon re-entry.
Is this mean that for EEA national ban is for 1year?

*In relation to deportation and not removal*

From what I understand an EEA national who has been deported must apply/make a request to have the deportation order lifted before coming back to the UK. There has been a very recent amendment to the EEA regulations which gives the Home Office power to treat (EEA nationals who return whilst there is a deportation order in force) as illegal entrants. I also understand it that the deportation orders remain inforce until revoked and do not have an expiry otherwise. Quite how that is 'human rights' compliant is another matter!
