Hello all, thank u for taking time to read this post,to cut the story short.I came to U.K,with a family permit, which expired in March.I had a residence from portugal.I lost it,and reported it lost, unfortunately the police gave me a piece of paper, indicating a lost item, and their telephone number.I explained to them I need a paper which states my full name and the lost of my residence card and also to include my residence number.I was told they don't issue such documents, despite explaining my situation that I need such to travel out of the country.I went to the Portuguese embassy, they were unhelpful.I was told my family permit has expired, that I am illegal.I explained I need have the right as family member to stay longer than my permit date. They told me they do not issue residence at the embassy, and the immigration service in Portugal is requesting I get a letter from the immigration in U.K,stating I am not illegal, despite me telling the officer it's boldly stated on the UKBA site my rights and status. All fell to deaf ears.I am currently working 2 jobs, cos my wife is pregnant.I am running against time.I have few days left before my residence in Portugal expires. Before the expiration of my family permit,I called the ukba and explained that I was working and my wife wasn't,do I need to leave the country before my visa expires. They said no,that my wife is excising treaty right as been self sufficient, since we are not using any public fund. I am thinking of going by train or bus.I was told the Uk border service are not concerned when your leaving.I intend to travel to France with my wife, and try and re-enter through calaias. I just want to be out of the UK,as soon as possible.I am now in a limbo.I have not applied for the residence card yet in the U.K,and I am still working,I have my work contracts, house contracts, and other proof of address. My fear is when I try to gain re-entry,will I be permitted back in into the u.k with an expired family permit.
2.I do not have a comprehensive sickness insurance.Since I pay tax,I do not know if I need to get one for myself and wife or just for her. Will this be a hindrance if I try to come back. Please can anyone give me links or stories about traveling using calais. I will welcome any advice.thanks

Your residence status in Portugal is irrelevant to your residence in the UK.

You don't need to leave the UK even if the Family Permit expires. As long as your wife exercise treaty rights you are legal.
Just get CSI (health insurance) for both of you and apply for residence card using form EEA2 when you wish.

Thanks Jambo.I have been the only one working...does she qualify under the category as self sufficient?.I do plan to apply for the residence here when I come back, but I planned on going to Portugal, but can't since my portuguese card is lost and embassy can't issue me a visa claiming that my family permit is expired and I do not hold a U.K resident card, despite me telling them my rights, they requested I should bring a letter from UKBA stating I am not illegal. When I called one of the UKBA contact center. They told me they don't issue such letters. That is the reason I have decided I will travel through calais.
If I apply for an RC,will it be enough to apply with my pay slips, and proof of address?.
Thanks.

Hi
I would like some help with my current situation.
I am a non eea national and am married to a portuguese national.
In 2009 i got a 5 year residence card which expires in september this year(2014). I have always been working and now my employer has approached me asking me to provide proof of right to work, and i have 6 weeks to provide them with the information ir i will be dissmissed. I tried to explain to them the i will be applying for naturalisation in december (6 year wedding anniversary), so i wont be applying for another residence card.
I phoned the employee checking service and was told that after september i will have no proof af right to work just the right to live in the uk. I know this is not true and i have been searching the internet for some form of guidance / documentation to print off and take to my employer.
Please help, any advice will be truly appreciated.
Thanks
