Dear members,my PR is due now after completing five years in the uk.but my Subject Access Request was refused and data protection unite said in the refusal letter that the interval between the previous request and the current request is too short therefore they refused my subject access request.
Two years ago before my second RC,I requested my SAR which was approved and now it is refused.
My question is this, will this subject access request refusal make any adverse effect on my PR application??

Your answer will be appreciated.

No it should not have an effect.

There is a policy they have, that a request cannot be made within 6 months of the last successful request.

However this will have no impact in deciding the merit or the outcome of your application.

Thanks Obie. But my this request is after 2 years and on the refusal letter they are saying that under section 8(3) data protection act, they are refusing my request.
And also very politely saying that do not correspond them unnecessary as this would double the office work and divert the resources.

Obie what can I do now??do you think that they will tag my PR application as my SAR is refused?

Write to them and complain that the provision they mentioned is inapplicable to you, and get your MP involved, to pressure them to release your file swiftly.

I believe it will have absolutely no impact on you application. It should not.

i think just because of shortage of staff at home office they will be doing that as it takes takes time one of staff members has to carry out the duty .
