Urgent advise needed.Civil partnership dissolvement

My partner is from the EU.Portugal.Am from Namibia.Came to the uk 2004.Met miguel and and in 2011 we decided we want to live the rest our lives together and we had a civil partnership in 2011.November.

Happily we rented a flat together .In 2013 his sister moved to the uk .The one that never approved the civil partnership with me.Sadly until this sadly hour I don't know why they switch on me and we departed our ways.Legally we did not dissolved the partnership yet .This year in November we would have been in the partnership for three years but extremeextrely sad i got a call today that he is proceeding with a divorce asap.

My European resident permit Expire in 2017.

Am in trouble as once the dissolve the goes through I got no right legally to stay in the uk...

I don't have money to pay for legal fees .

I need urgent advise of people that went through the same situation.

plseee help.

I feel like I'm dying today

I'm on a European resident permit till 2017 but my partner family is pushing him to dissolve the partnership ASAP.

I need the help of a good solicitor that deals with this cases

From 2011. this year November it would have been three years

I did ask for him to wait until November

But after our meet today with him to hand over the original civil partnership certificate he made a false claim the man reason for the divorce is domestic violence but I never did any of that kind and there's no evidence .I love this guy with my life and he was just browsing through the list of reason of the dissolution and pick a reason that is not true


He also want me to pay for the divorce .And I'm not the one who really want a divorce him his family and him
I serious need help and advise .

You can simply ignore signing the divorce until November.

That option is open to you. Tell not to let him know your address. That is all you can do for now.

Can you recommend me to a good solicitors that I can just keep on handy. That's if I need urgent help.

by the current situation if I don't do what he request he can become nasty and he got my Adress already.

Family Solicitor can be pretty expensive, and they will have no power to stop your spouse from getting a divorce.

What they can do however, is simply advise you to delay the divorce process by not signing the papers.

If you choose to havve them know your whereabout, then that is up to you.

Have you asked yourself what a solicitor can do for you and on what grounds you need the solicitor.

I think you need to first understand divorce process in UK and divorce grounds. that way you equip yourself with the correct information.

Like Obie CORRECTLY stated. you do NOT sign the notice of divorce petition and you don't let him know your address. you don't need to spend your time being worried. no one forces one to have a divorce. November is in 6 months , your target should be to drag it on till then at the earliest.

I am not sure what the "solicitor that deals with serious cases" will do for you other than charge huge sums. you also wrote you don't have money to spend.

Get yourself together.

I did not choose to give them my Adress but they know my where about:(.

So you suggest : If he goes ahead and do the divorce I can delay By not signing it.Will I need a lawyer for that?.

Also he claim the reason for divorce is domestic violence because but there was no such thing.How can I protest against it.He has no proof of violence at all.I love this guy so much and I would never ever have done such a thing I'm my life.

He is also forcing me to pay for the divorce not him .

Not sign = don't sign - why would a lawyer be needed. Just say you don't agree.

You pay = don't pay. How could he possibly MAKE you pay? Just make sure he doesn't have your bank/credit card details.

I thought my world is coming to an end but I will take the advise

One more thing how can I contest against the domestic violence claim if he have no proof and God knows there was never domestic violence in our relationship .All my friends that knows me is shock

If there will be no divorce, there will be nothing to contest. Any contention will take place after November.

That opportunity will be open to you then, to contest these claims.

Well, I dont think I can assist with that.

I they put you under duress to sign, it will not be valid in law. You can report them to the police.

You are best advised to cease contact with these people until november.

They could get bailiff to serve papers on you, so keep away.

We can only take the horse to the river , on this forum.

He is a nurse and works in the Nhs.He is getting alot of pressure from the family to do the divorce asap.

I'm not worried but I know his family is not nice people and they will do everything in their powers to make my life he'll.Am sure it's them to advise him to lie about the reason for the divorce is domestic violence:( .

After the separation last year I did not hear from him until last week Friday .I met with him and I he recorded our conversation on his mobile .He told me that I need to pay for the divorce and I had to hand over the civil partnership certificate which I wanted to keep as a memomentum for me .

I got a job as a phlebotomist and work in a private hospital and been here from 2004 legally.Met him in 2010 and we did a partnership in 2012 but sadly his family broke the relationship up.

At first I was worried as I don't know the divorce laws but im aware of them now but im just concerned that him and his family that I adored and loved as my own will make my life he'll.

legally from 2004? in what capacity? did you have another type of visa? would there be any way you are entitled to stay here based on another immigration rule?

I'm not familiar with this but if you give more info other people might be able to advise.

2004 to 2006 was on a working holiday
2006 to 2011 I was student visa
2011 November we did a civilpartnership as we got ma fly in love and wanted to build a life together.Went on two honeymoons to Madeira / Portugal where he is from.Met all his family but they was just ok with me.
rented a flat together from 2012 til 2013 July.came back in may 2013 from our second honeymoon.He pack his stuff and left .I could not believe what happened.I was down and under but I pulled myself together .From laSt July till this last week there was no communication.Just got a text to meet him and yo hand over the civil partnership certificate and was been told to pay for the divorce not him but me.Also The reason he stated is domestic violence of which there was never any violence .Am shocked and friends can't believe it's true.

That's my case ..

I paid. lawyer £380 plus vat and what he told me in five minutes I got can't apply for anything and I got no case to fight .

Can't apply for a work permit as I don't qualify.
Can't apply for the ten year route as I don't qualify.

Onl way is to pray to my God that this person and his family leave me alone till November.Than I can see if my God will help me with an application to retain my rights here.

( This is the words of a solicitor)..

On my way home from him I found myself on the street crying and one kind lady directed me to this site to tell my case

I believe the lawyer is wrong. You will qualify under the 10 years long residence provision, provided you have accrued 10 years resident in the UK.

What month did you enter under the working holiday maker provision?

Have you got prove that all the time you were together, this guy was working?

I believe grounds for divorce is right, but it seems to me, that you were the victim of DV.

Yes from we met in 2011 He was working as a nurse .

I never left the uk for more than a year.So from 2004 to 2014 I have been here legally.But I met my partner only in 2011.Eu resident permit valid till 2017.

I have done a Academic English test in 2011 .Does anyone know if I have to do a new one?

Just want to hear from other couples out there: My partner accused me falsely of domestic violence .How do I contest this-/ this claim is going to spoil my future and i stil in shock when he told me the reason for divorce is Donestic V.But there was no such thing
