hi to everyone who helps me about my problem
my story is a bit diffrent,,pls i need help
im polish girl who married with algerian guy
we got marry in algeria april 2011 and he came to england with eea visa july 2011
then he applied residence permit and got it,,expired december 2016
recently he left home and started living with one of my friend.im so sad even by writing here these things.
i feel myself to be used by him to come england.i was very nice wife to him,he just cheated me so im very angry about it,
i want him deported from uk..what can i do? pls help me
1---if he wants to divorce from me,,if i dont,,can they deport him when his residence permit expired?
2---if i divorce from him and im sure he will apply for ror,if i dont give him anything about my documents,,that time he will be refused and they can deport him?
3---if i phone home office,,they have authority to deport him?
4---if there is another option,pls tell me

He can be deported under regulation 19 and 21.even after ROR.
Just call to home office and tell them.

I personally think that your desire might not fulfill because even EU directive give you a lot rights. Because even you divorce him but if he is living with another EU national then he can again become EU family member.
Regulations 19 & 21 is irrelevant here which only come into play if there is issues about public safety/health etc.

Just forget the loser and your 'friend'. Divorce him and end communication.

I'm sorry to hear what's happened to you. I'm afraid if you've been married for over 3 years and have spent at least 1 year as a married couple in the UK and if you are both economically active during the divorce proceedings, your husband can retain a right of residence in the UK. Your husband must continue to be economically active after the divorce to keep a right of residence in the UK until he achieves Permanent Residence.

However, when your husband applies to the Home Office for a Retained Right of Residence, he will need to be able to prove to the Home Office that you were economically active during the divorce proceedings, and he will need to be able to prove that you and he have lived in the UK at the same time for at least 1 year. That might need some co-operation from you, which of course you do not have to give.

Your husband is not a threat to public policy/security/health, so I'm afraid he cannot be deported under Regulation 19 (or Regulation 21) for those reasons. He could be deported under Regulation 19 if he ceases to have a right of residence, but if you have been "legally" residing in the UK so has he and so he cannot be deported.

If your story is true then home office can take enforcement action against him even after PR under regulation 19(3)(c).
Now home office taking steps against those persons who successfully gained RC of ROR or PR by deception or sham marriage etc.

If your husband used you just to gain the long term residency then since January 2014 Home office can take enforcement actions against him and can deport him under sanction 19(3)(c).
Just call to home office or sent a e mail with his details.

Unless you proceed with divorce and stop exercising treaty rights, he will have a right to be in the UK.

To do the dirty with you best friend is a ghastly act. He could at the worst had gone to another person, just pure evil.

Um maybe its wrong to be condemning the other party here, there does seem to be a bit of spite coming from the OP's post.
