EEA4 application and out of UK more than 90 days

Hi members,
I have to apply for EEA4 application end of this year (2014). But I got a problem that I'm very sick for last 2 months. I got admitted in hospital in England for 5 to 6 times in last one month because of severe medical problem. But I was not getting better at all. Then I came back to my home country (out of EEA) for private medical treatment, plus I did not have any family member over there in UK to lookafter me in this situation. Here I just had an operation to fix main pain. But I'm still sick. And can't travel back to UK with this medical condition. My question is this, that can I not apply for EEA4 this year if I exceed the limit of 90 days, when I'm seriously ill. Or it is possible to apply, when the reason of exceeding 90 days limit because of medical problem.

please tell me. I really need to know about it.

If your absent from the uk is less then 180 days then nothing to worry.

but the law says that the year when you are going to apply PR, you can not live out of UK for more than 90 days. How could you say 180 days? Can you explain please?

:shock: :shock: which law says that? do not confuse EEA4 with Citizenship!

Dear members,

I'm really ill, and just came back today after 6 days from hospital. And just opened this page now. Could you please tell me in easy way (and if you can give me some reference as well, then it will be grateful), that EEA4 gives me 180 day margin to stay outside of UK in last 12 months before application.Then at least my this problem will be sorted out.

plus, what us the difference between EEA4, ILR and PR? (if somebody can tell me)

Just look on page 6 of the EEA4 application guidance notes:

"For your residence in the United Kingdom to be considered continuous, you should not be absent from the United Kingdom for more than six months each year. Longer absences for compulsory military service will not affect your residence. Additionally, a single absence of a maximum of 12 months for important reasons such as pregnancy, child birth, serious illness, study, vocational training or posting overseas will not affect your residence."

ILR falls under domestic Immigration Rules, and PR falls under EEA Regulations. EEA4 is the name of the form to apply for PR. You need only concern yourself with PR as ILR doesn't apply to you in your case. Once you are PR, wait 1 year and you can apply for British citizenship.
