EEA2: Temp employment route

Hi all

I'm back in the UK and have been made a number of employment offers. Some of these are temp contracts, e.g. for 6 months with the possibility of extension. We meet the other requirements for the EEA route, but I have a quick question about my employment options.

Does anyone know (or have experience of) whether my non-EEA civil partner will still be able to apply for EEA2 when I'm on a temp contract? I know the application form asks how long the employment is likely to continue. If I were to write 6 months would it be likely that they might think this is too short and refuse the EEA2 because of this? Of course, I would have something else lined up for after the temp contract was finished, but, again, it may just be another temp contract. Is that acceptable?

I have a few permanent offers too, but the salaries are REALLY low and I'm not interested in the work. However, I'm willing to take one of these if they make my partner's position seem more stable and allow him to successfully apply for EEA2.

I'm sure many people face this kind of situation and I was just wondering if anyone had experience around this?

For EEA2 RC application the present treaty rights evidences need, therefore temporary employment contract should be fine. Sometimes caseworker process the application very slowly and if by that time the contract has already been finished then the employer will not confirm to caseworker on contact and application could be refused. That's why it will be wiser to apply eea1 together which process more speedily and it can reduce the refusal chances of eea2 on the grounds of treaty rights.

Well done on getting so many job offers after only being back such a short time.

I'd be inclined to go with the lower paid permanent contract work for the sake of the EEA2 application. Does the permanent job promise any future promotion that would improve the salary?

Once your partner gets the RC you might suddenly decide that you cannot live on such a low wage and opt for the temporary work. You'd still be exercising treaty rights as a worker so you wouldn't be breaking the terms of the RC. It's a tough decision though, you're very fortunate to have this dilemma :)

Good idea Lunargirl. That's what I was thinking about too. It might be the best way to go.
