Dear all,

I have been worrying about the applications of my EEA3 & my wife's EEA4. I have to admit that we are not well-prepared for the applications. We are panicking now as my wife's RC will be expired in 09/2014.

I have been working full time since 2003 except that I left my job in 12/2011 and was financially dependent on my own savings & my wife's employment for a year. I have no proof of job seeking as I planned to set up a business with a friend who left the UK in 11/2012. Therefore, no business had ever been started.
I got a job in 01/2013 until now.

We have no CSI or EHIC too. I would like to ask what was my status in 2012? Self-sufficient? We have never claimed any kind of benefits in the UK. Would it help if we get the CSI before we apply?

If we are not entitled for PR, could my wife apply for another EEA2 again before her RC expires?

In 2012 your status was legal in the UK but as you don't have any proof of CSI and you was not registered as a job seeker then this year will not count in your PR application.
So applying RC again and start your pr time from 01/2013 is a absolute advice for your.

Thank you for your prompt reply, Imshzd. In your opinion, can my wife apply another RC now, or she has to wait until one month before her RC expires (this September)?

She is desperated now. She might have to return to her home country in the next 2 months as her grandfather is really sick at the moment. Thanks again for your help. I appreciate it indeed.

No problem at all if she apply RC again now.

It appears to me, that there was a continuous period of over 5 years when you were in employment.

From 2003-2011, provided you have never left the UK for more than 2 years, then I believe your wife could qualify for permanent residence.

Thanks for your helps so far, i got a csi cover with simplyhealth for both of us eea2 and my eea wife at £47 per month.

However i think my eea2 is about to suffer a set back i can only show £3,500 in my eea's savings account and £95 in my (non-eea) account, is the money enough to show she is self sufficient ?

You have in fact been a Permanent Resident since 2008. Have you got proofs of working from 2003 to 2008, or indeed any 5-year period? If so, this is ALL the proofs of exercising Treaty rights that you need submit for EEA3 and EEA4; and then from 2008-2014 (or after whichever period you can prove you were PR) you need only submit one official document in your name such as a utility bill from each year - this proves you were not absent from the UK for more than 2 years as absences of over 2 years result in the the loss of Permanent Residence. Your wife will also need to submit 5 years of proof of residence in her name for her EEA4.

As a Permanent Resident, you legally no longer have to exercise Treaty rights. You wife can legally reside with you if you are a Permanent Resident, even if you don't exercise Treaty rights
