eea2 unmarried partners with baby girl

hi to everyone i got alot of information from here and submit my application ..
acutlly me non eu partner of eu national we r in a relationship since nov 2012 we have 1 baby girl as well ... and my partner had a misscarriage of my first baby on 2nd may 2013 in romford hospital cause the doctor could heard the heart beat so after words now God blessed us with a baby girl on 2 march 2014 and my wife is working 24 hours a week at minimum wage .
i applied for asylum in uk which was refused and my last three hearing were adjourned without reason at last hearing the barrister of homeoffice and judge advised me to submit an eea2 application so i did it on 18 of june 2014 coa recieved 29 june 2014 and i recieved a letter from court that my court hearing will b on 1 sept 2014 so i m confused my eea2 application still in process so can the jugde of court give any direction to the home office for the issuance of the rc or what gonna happen in court .... as it is my asylum court mostly the judge is interested in our human right case as well so please give me advise as all advises will be appriciated....? If the Home Office have not dealt with your application up to the day of the hearing, the judge will be entitled to assess your human right case, and if he /she finds that you are in a Durable Relationship with your wife, you appeal will be allowed under the EEA Regulations aswell, and it will be remitted to the Secretary to consider how to exercise the discretion under Regulation 17(4) (5)

thnx for the advise so i told you all my situation ...? do u think the judge or the home office will give me rc if both refused me then what should i do .....?

my solicitor said she will not come in court i am very worried about it i dont have enough money to hire another my court is on 1sept please give me advice what should i do refer me any cases that i can speak in court please obie help me out please i ll b very thank full to you pleaseeeeer
