EEA Spouse exercising 5 years treaty rights

Hello all

I'm new to this forum and have been reading through the forum to find an answer to my situation but without success. I (non-EEA) want to apply for EEA4 with following given details but I’m unsure if I fulfil the 5 years treaty right requirement:

• I’m legally in the UK since 25/07/2004.
• I'm a non-EEA national married to EEA national since 01/07/2008.
• I'm continuously employed since 01/07/08.
• I have a “residence card of a family member of an EEA national” with expiry 14/08/15.
• My wife (EEA) studied from 24/09/07 - 30/06/09 at college. Worked from 23/11/09 - 21/10/11. Studying at university since 20/09/10 to complete on 31/07/14.
• My wife (EEA) owns a German EHIC card which was issued 6 years ago.

I have tried to read into “Economic self-sufficiency” if this can be used in my case but did not find any satisfying answer. If anyone can advise if that applies to my situation and how to apply.

Also my wife had a break in exercising treaty rights from 30/06/09 to 23/11/09 where she was looking for employment but was not registered at job centre. We might have some refusal letters dating around this period. Can we present those letters to fill the gap?

Another option we were thinking is that if she starts working after finishing university 31/07/14 up to 22/11/14 to complete her 5 years treaty rights from 23/11/09 to 22/11/14. Would that be the best option?


I would really appreciate if someone could advise in my case.

Did she require/have WRS when working?

Do you mean working register scheme? If so then no. Is this even required for german EEA?

No it's not required for German nationals.

A “jobseeker” means a person who is seeking employment and who can provide evidence that he is seeking employment and has a genuine chance of employment. Evidence would consist of the CV, job applications, and similar correspondence.
