EEA4 - Making sure I send the correct supporting evidence

Hi all,

We will be sending our documents this week for my husbands EEA4 application. We used the Surinder Singh ruling originally as I am British. (He has a Residence Card and Entry Permit in his passport). Of course I am now panicking trying to make sure we're sending enough!

This is what we have enclosed:

Personal Documents
Cover letter
• EEA4 Application
• Our Passports
• 2 x Colour Photographs
• Marriage Certificate (Unabridged and Bridged)

Proof of Employment
This covers the entirety of our time in the UK since arriving on 7th October 2008. We have been employed by the same employer’s continuously, with no gaps in employment.

• Letters from both employers confirming our status/employment
• 3 x Recent Wage Slips – Me
• 3 x Recent Wage Slips – Him
• 6 x P60 – 2009-2014 – Me
• 6 x P60 – 2009- 2014 – Him

Proof of residence
We recently left rented accommodation and moved in with my parents with a view to start saving for a mortgage deposit. As my parents are the home owners, we do not have many utilities/bills in our name, however we have included the following:
• Letter from homeowners
• Utility Statements for Gas/Electric with both our names
• Council Tax Bill – closing statement of previous address, sent to current address.
• Virgin Media Bill
• Electoral Register Application receipt x 2
• Recent Credit Card Statement - Me
• Recent Bank Statement - Him
(They can also refer to recent wage slips as these also show our current address too)

October 2011-April 2014
• Receipt of Rental Deposit
• Joint Tenancy Agreement and a Notice to increase Rent last year
• Utility Bills in both names (1 in each name, they are random dates)
• Annual Council Tax Bills 2011-2014

October 2008- October 2011
• Joint Tenancy Agreements 2008-2011
• Annual Council Tax Bills 2008-2011
• Utility Bills in both names (1 in each name, again they are random just to show we have them)

Does this seem like enough to meet their requirements? Should we send more utility bills from our previous addresses? do we need to send bank statements too? we get online statements so I'd need to order them from the bank which is a big hassle - they post each month individually which is crazy!

For PR under Singh I believe you must supply the evidence of exercising treaty rights in the other member state before moving back here, just as you did before. Although those documents you have listed may not be actually needed, I think you've done well keeping them all together none the less. Now just get the ones that are required, what you used previously.

Hi Amber, thanks for your reply.

If I am not mistaken, the EEA4 form has changed recently which negates the need to re-send the same evidence we sent with the EEA FP and EEA2 application (i.e. proof of exercising treaty rights in another member state). If you refer to section 6, under applying via Surinder Singh, they ask:

"Have you, or any family members included in this application, previously been issued with
a residence card under the Surinder Singh judgment as the family member of the British citizen
named in section 3, or did you/your family members enter the UK with an EEA family permit
issued as the family member of that British citizen?
"

We answered "Yes" and they instruct "go to section 8"

Which basically skips all the questions about previous member state, employment etc.

I did call the EEA department to clarify... the guy there agreed we do not re-send that info/documentation because it has already been established that we exercised treaty rights, given that he received a EEA FP and 5 yr residence card. It makes sense.

I was shocked, to tell you the truth. Seems like they have made efforts to make it a simpler process?

So we did not re-send that evidence, all the documents we sent are relevant to the last 5-6 years we have been in the UK.

Ok then that's fine. You are right the forms were changed a few weeks back. You should have no issues then.
