I was happily filling in my EEA2 thinking that I have all the necessary paper work, BUT...

I am a Dutch national who has been residing in the UK since 1999. I have three children, all of whom are also Dutch nationals. My husband is not EEA, but has been working part time since 2010.
In the past five years I have been self employed, worker and a student. I just about finished filling in the EEA2 form when I came to the realisation that as a student I need to provide a CIS for me and all of my family members- for the past five years!?!! The problem is that I have always been under the impression that since I was never asked to provide anything I assumed that I would be ok when the time comes for me to apply for my resident permit.

I read somewhere on the internet that people apply for the CIS just before they are about to submit their application, is that deemed acceptable by the HO?

As far as I understand it you will only need the CSI for the period that you are/were a student. Since you are talking about an EEA2 Residence Card you should only need to demonstrate how you are presently exercising your rights.

When applying for permanent residency it may pose some complications but that would be a separate matter.

If you are a student presently, just get the CSI and then apply. If at anytime you plan to be self-sufficient (not studying or working) make sure the entire family has CSI.

Since you have been self employed, worker the past five years - you only need proof for those years and by proving that note that you are due for Permanent Residency and thus no longer need to demonstrate proof of treaty right for your husband EEA2 this year.

As you have been living in the UK since 1999, I think you already have acquired permanent residency and as a permanent resident you dont have to be excersing treaty rights anymore.
I am not 100% sure about that but we can wait and see if someone can please clarify it.

Thank you all for you replies. I saw an immigration solicitor today and he clarified everything to me.
First off though, I have to clarify that I was talking about the EEA3 for and NOT EEA2 (all those numbers!!).
Apparently since I have not been insured while being a student, I will have to wait another five years to be eligible to apply. That is if I want to apply as an EU national.
He did advise me of applying using the 10 years legal status in the UK which sounds great except that I will have to pay about £1091 AND my husband will have to switch and wait another five years to be eligible to apply for his Indefinite leave to remain. This is all so unfair because had I been aware of this 10 year rule, I would have gone through that path instead of waiting for my 5 years to exercise my rights as an EU.

You can't go through the 10 years route if you are not eligible under the 5 years EU route. The solicitor was wrong.

How long have you been a student? Did you work part time during that period? Did you have health insurance in the Netherlands during that time?

I have been in the UK ever since I was 13 years old! :/!!!
I will have been studying for five years in Sept 2015 (currently doing MA part time).
I did work in the first two years during my studies.. ad hoc jobs since then :/

Jambo is right, you cannot be eligible under the 10-year route unless you were legally resident throughout a 10-year period in the UK. Presumably you came to the UK with your Dutch parents at the age of 13 in 1999? In that case you were probably PR in 2004 as an 18 year old, not as a Union citizen, but as the family member of a Union citizen.

I am really in need of advice. I have been in the UK for over five years now and my EEA3 application got rejected on the basis that as a student, I did not have comprehensive sickness insurance. I am currently looking to get a comprehensive sickness insurance and re-apply. I was wondering if I need to have had the CSI for a continuous five years or if all I need is to simply have CSI. Reason I am asking is because a friend of mine applied for permanent residence in the UK by simply getting the CSI and applying for EEA3 as a student through a solicitor and he got the permanent residence. So can I just obtain a CSI now and send an application or do I need to have a solicitor for my application to be successful?

Please let me know if anyone has applied for this and what was asked of you.
