Overstayer Wife Please help

Hi.

I am a British citizen currently living in the UK with my wife from my Guinea Bissau. She came to the UK in 2008 and become a overstayer when her visa expired in 2010. In 2011 she was found by the HO and told to report every month after that. We got married late 2011 at the registrar and have since tried everything to resolve the issue.

We have decided to go the EEA route, for me to go to a EU country for a year then come back to the UK as EEA citizen.
My wife lost her passport and it has been near impossible to renew it from the Guinea Bissau government and there is no embassy or consulate in the UK.

Can i go alone for 9 to 11 months and return as a EEA citizen then apply for the EEA family permit ? I am currently working but not earning 18,000 a year.

Any advice will be greatly appreciated.

Have you got a child together?

you have to go together for her to qualify

You will have a problem trying to get a visitor visa for your wife to be able to enter another EU country. Maybe just turning up at the border would work.

They will insist she can come back to UK for at least 3 months after the visa runs out. Obviously as an overstayer she cant.

No, We dont a child yet. We are trying.

Where does it say that she has to come with me? Please share.

Can she still travel with no passport? Can't we renew her VISA when it runs out?
