EEA Family Permit - Dependent Child need advise asap

Hi all,
Just a quick question. My husband will be applying for the EEA FP this coming week. Last year he applied for a tourist visa (before we got married) to go on holiday but he never used it. During that visa application they asked if he had a dependent child and he stated yes but I have now come to realise that maybe we made a mistake.
The child is 4 years old and lives with the mother ( they never married) but my husband did go to court to set the child support amount. Hence why he stated that he has a dependent child.
Is this correct??? I am worried as we now have to fill in this info for the EEA FP and we do not know what to say...yes he does have a dependent child because he pays child support or no he does not?? I also worry that if we state NO that they may think we are fooling them as he said yes for the UK Tourist Visa last year.
