2 of my friends got their Residency but it is restricted.

Hi everyone. Can anyone explain to me or just enlighten me on what is happening?

Well, my to non eu friends received their residency just this month and it was restricted which says that if their British spouses dont continue exercising treaty rights then they will discontinue the residency. I dont understand it as they both applied through Surinder Singh. Are there any changes to Surinder Sinder route atm?

What do you mean by it was restricted? I suspect you refer to the letter that comes with the Residence Card. If this is the case, they can just ignore it. It's just a generic letter that doesn't really apply to Surinder Singh route.

Well to be honest Im not quite sure. Forgot to ask. Basically, they both called me saying they received their Residency but they said that they both have the same restriction.

"Husband has to be working and exercising treaty rights, if not residency will be forfeited."

I was really surprised as I am fully aware that as a spouse of British citizen we are allowed to live and work without any restriction even though the Spouse is not exercising treaty rights, both couples doesn't have any jobs at all ( don't know if it affects the application at all )

On the other hand, I will be applying soon and Im quite worried to receive a COA with no right to work as I am working full time as a Hotel Supervisor, do I need to stop working if I receive that kind of COA?

There is no such restriction. It is probably them misinterpreting the accompanied letter that has no legal bearing and is not relevant to SS route.

If you get a short COA (no right to work), complain and ask for a full one as this should be issued in SS cases.

I guess they just misunderstood it.

I will send my application this month so we'll see what will happen. Thank you for your help xx
