Student but claiming JSA at the same time

Hi all,

I am going to get a council date for marriage in the next few weeks and going to apply for the EEA2 sometime in december this year. My EEA partner was working till August 2014 this year and then She applied for JSA and didnt attend any interviews. The best part is this morning i have received a letter saying that her claim is passed and Job centre will start paying to her. But at the moment she start studying in college. As a Member of EEA she is exercising her treaty rights in UK as she is student and she can sponspor me for RC. but she is taking a JSA also so please tell me shall i stop JSA straight away or shall i continue with it ?

What would be the best thing

She can't claim JSA is she is no longer available for work. ie. She is no longer 'job seeking'
Is she paying comprehensive medical insurance for you both?

Thanks for the reply. My solictor said to me to start the health insurance when you will be applying EEA2 so i will buy the insurance sometime in November.

You will need CSI (health insurance) from the time your EU partner became a student. She should stop claiming JSA immediately.
