My Residence Card expires soon, what next?

Hello guys,

My Residence Card of a Family Member of an EEA National expires in 5 days, I've really forgotten about it, until I checked my passport today.
Could you please tell me what's going to happen next?
Do I need to apply again? And which form should I use?

When I was issued with this Residency Card back in 2009, I have been told that, once expired, you can apply for an indefinite Residency document.

Thank you.

Yes, as long as your EEA citizen family member has been exercising treaty rights (worker/self-employed/student with CSI or self-sufficient with CSI) you will be able to apply for permanent residence in the UK on form EEA4. More info here: https://www.gov.uk/government/publicati ... -form-eea4. Read the guidance notes for more info.

Your EEA family member can also apply for PR on EEA3 if he/she has been exercising treaty rights for 5 years if they like. However, EEA nationals get PR automatically (so they say at least) & there isn't a requirement to apply on form EEA3.

Thank you very much for your answer chaoclive

Can you explain to me what is PR ? I am not really familiar with immigration forms

My wife has Residency Card since 2005 and she's been working since then.

PR = permanent residence (the EEA equivalent of indefinite leave to remain)

Where is your wife from? She wouldn't get a residency card if she is an EU citizen. She may have a registration certificate (applied for on form EEA1) or perhaps she has registered under WRS (the workers registration scheme) for A8 nationals? Or do you mean that she also has permanent residence in the UK.

Google will help you to clarify the terms.

Right, I see

Yes, you are right, I remember the EEA1 form, she definitely has the registration certificate, it is a blue card. My wife is Latvian

OK. Now you both can go ahead and apply for PR on forms EEA3 (her) and EEA4 (you).
