non EEA father of EEA child wants a divorce

Hello there!
My husband and I want to get divorced. He is on a 5 year visa which will expire on 4th January 2016. I am EEA national (Austrian) and living in the UK for nine years. We were married for 3 years and living in the UK for the last 5 years. We have a child (22 months). I m not working since 2 years. Will my husband be able to remain in the UK after the divorce? Will he be entitled for RRR? Which papers will be necessary for the application?
I didn't exercise my Treaty rights for the last 2 years. Will this influence his application?
