Please Advise :( . EEA2 Unmarried Partner without 2 years.

Hey guys ,

I arrived in the UK on August 2013 , And got in a relationship on January 2014 with a German national who has been living in the UK for the past 14 years , She's a student in University and so was I.

Anyways , My visa was going to expire and the university gave me an extension CAS which I applied for , the extended visa came back expiring on the same day .

On the same day I applied for an FLR O because of this reason , but the application came back invalid as they were unable to take their fees for some reason . Im still not over 28 days from my visa expiry.

Now , I am going to apply as unmarried EEA2 Partner in 2 days , me and my girlfriend have been living together for about 8 months + now and have proof showing the same.
We have utility bills , Medical insurance .etc


Now this is where I need advice .
I do not want work rights or anything on my COA as I will be continuing my university education , and me and my girlfriend do plan to get married in the coming 6-7 months.(ie. We are engaged )

Now the question is ,
I know theres a high chance that the unmarried partner EEA2 application might get rejected ,
But is it possible to get married while such an application is pending ?
Would the UKVI show up for our marriage and detain me ? Can they do that ?
After application , Is it okay to request my passport back ?
Also , Is it possible for me to open another bank account or get a driving license while my EEA2 Application is pending ?

You are unlikely to succeed in this application as the relationship is pretty short, there are not child or children, no joint financial commitment.

UKBA will not return your passport if your leave has elapsed.

You are likely to succeed if you got married, and the marriage can be proven to be genuine.

How can I get married while my leave has elapsed .

Can I get married while an EEA application is pending ?

And what would be considered a joint financial commitment ? A house ?

We have a house together that we both own . Does that make any difference . ?

It may well do, but i must say, it is not a straight forward case.

Evidence of a relationship that exist prior to this 8 months of cohabitation may also help.

You may also wish to seek assistance from a competent adviser.

I meant we started living together in January . We have been in a relationship before I came to the UK.

We have convesation logs as evidence prior to this . Also the day we first met we took pics .etc
