EEA2 as a Tier 4 Overstayer

My current leave to remain has expired on 30th October. It was a tier 4 student visa. I got married to an Estonian girl on August 18. She is still lookinf for work and hence I am not eligible to apply for EEA2 yet. Recently I came across the 28 days overstaying rule. My question is, can i still get a EEA2 permit, if my wife starts working, say in a couple of months, by that time I will have overstayed by 70-80 days, can I still apply as an overstayer and get the RC? Also, do I need a visa to Travel to Estonia?

I'll appreciate it if you people could help me out here.

I have a clean immigration history, and so far never been rejected for any visas. I've known my wife for over a year, but she hasn't been working from December dueto the lack ofappropriatejob. She was on JSA till October but it also ended.
