ROR Refused

hi everyone
i did applay for ROR after divorce and i have got refused cuz my ex wife she was in jobseeking for 3 years which i didnt submit any proofs that she been seeking for a job and also the other reason is thy said i didnt proove them that we lived together for 1 year .which i have send them fiew letter on my ex wife name in same address as she dont have all her letter she lost everything when she moved the house ,and i send them all my payslips and bank statment on the same address i thought that enought prooves that we was in same address .
is the 2 reasons why thy refused me now i dont know what to do really i have 14 working days to apeal or contact them to leave uk .
can i still apeal even if i dont have fresh document showing she was looking for a job ?
plz need ur advice as soon as possible .

I believe you should appeal the decision, and do it before the deadline.
Also try and resolve the issues raised.

thx for the reply .u mean i can appeal and tell them that the decision wrong?
and yeah i can gather some evidence that she been looking for a job but the problem is no time to do so .

Could you give the exact wording on the refusal letter, it may help people directing you in the right direction

this is what thy wrote .
your sponsor has written in her statement that she has been a jobseeker since 2011.this means she was a jobseeker for three years at the point of your divorce, the regulation stipulate that a sponsore will qualify as an economically active person if they exercise their treaty rights as a jobseeker for more than 6 months in a 5 years period,your sponsor wa a jobseeker for three years and was still a jobseeker at the time of divorce,as she is now, therefore she has not fulfilled the requirement of regulations,
it is also noted by this department that there is no evidence that you resided with your sponsor for one years during marriage .your sponsor explains in her statment that you were married in 2009 and in 2010 experienced relationship troubles,finally divorcing in 2014.
you have failed to provide evidence that you meet the requirements of regulation10(5) and and you have therefore not retained a right of residence following divorce,or that you have resided under the regulations for 5 continuous years to qualify for permanent residence.
and they also wrote this about appeal :
you are entitled to appeal against this decision under 82 of the nationality immigration and asylum act 2002 and regulation 26 of the immigration(eea) regulation 2006.a notice of appeal is enclosed which explains what to do and advice from the legal services commission on how to get help.
the appeal must be made on one or more of the following grounds:
1/that the decision is not in accordance with immigration rules
2/that the decision is unlawful becauce it racially discriminates againt you
3/that the decision breaches rights which you have as a member of and EEA national's family under community treaties relating to entry to or residence im the uk
4/that a discretion under the immigration rules should have been exercised diffrently.
5/that the decision is otherwise not in accordance with the law.

Thanks - the things is homeoffice is very harsh when EEA stay as jobseeker for more than 6months, i have not come accross any law which justify that, but they do reject application on this basis.
was your wife seeking job during those 3 years, if yes can she gives you CV and response received from the different companies she contacted. Also while living at the same address your wife had her bank card registered at this address or some utility bills, if yes then, can she contact her bank of the service provider so that they provide old bills stored in their system.
if she will provide those - then quickly launch your appeal and gather everything requested.

hi thx for ur reply ur really give me some hope .
yeah she can provide me with her cv and some letters from job aplication.
and yeah everything on that house it was in her name so all bills and her ban statment in that address aswell but the thing she dont have them .
and to gather them need some time cuz this service thy will not provide her with this bills or statment in 5 days .
which is the time i have left to aply for appeal or leave .
can i send appeal form then i gather the things i need in that time waiting for appeal ?

Hello everyone
I have a submited an appeal agains ROR refusal on 11 december then thing is i still didnt recieve any replay from the court or any date of hearing .the court took the fees from my account .
my question is shall i be worried as i dont know what happen with my appeal or it does take time to get the appeal date .
plz advice me as am a bit stressed .

It takes about 6 to 8 week, I got mine in 6 weeks but it may take longer. If they took money then soon you will receive letter

U sent the appeal on ur own or u use solcicter?
Ror is hard case nd u must have assist specially i see ur case is so hard nd complex . Im aftee ror nd my case well straighforward but i still have assist
best one for ror is obie . He is really good in tht issue . If u got refused u will be diported from uk so dont go throught appeal alone seek assist .
