ROR complex question

hi,,
if non eu national is about to apply for ROR on the basis of his marriage termination where marriage has lasted over 3 years and the couple has lived in uk together for over 3 years. The EU national is eligible for her permanent residence card. The only problem is at the time of divorce, the eu national would be in full time education with student loan but does not have comprehensive health insurance.
So in this scenario, can non eu national would be able to secure his ROR???

If EEA national was eligible for PR before the termination of marriage or already acquired PR status then there is no requirement of CSI,but Non EEA national must have to prove this at the time of ROR application.
