EEA2 application after FP expiry date

Hi,

I needed some clarification regarding the EEA2 application.

My wife (currently FP) is going to arrive in UK near the FP visa expiry date. I (EEA-national) am unable to apply for her EEA2 straightaway since I have to travel out of country in the very same days, and hence need my passport.

Am I allowed to apply for her EEA2 visa after my return, when her FP will have expired but she will be in the country? Or is there a more appropriate way to go about it?

Don't worry; applying after the date of the EEA FP is fine. She will still be legally in the UK and you will be able to apply when you get back. The most important thing is that you are exercising treaty rights and that she has some proof of residence, e.g. her name on the TV license/bank statement/gas bill etc. This can take a while.

Of course, depending on the dates of your trip, you could apply for her EEA2 first and then request your passport back. Just be careful with this though as the Home Office are not always the best at returning documents on time.
