Hi Guys
I am a non eea national married to a eea national who has been exercising her treaty rights. We will be due 5yrs in June and I was wondering if we could file in the application for PR in February instead of waiting till June. Furthermore I printed the forms eea3 and eea4 (38pages each) can we send them together ? Lastly how long is the anticipated wait time till we get our passports back. Thank you inadvance for your responses. Tony

EEA4 cannot be sent before completing the 5 years from the date of wedding with a qualified EU national partner. However, if the EU national has already completed its 5 years while exercising its treaty rights then eea3 application can be sent before sending the eea4 application. The both applications can be sent together too with the same single set of 5 yearly treaty rights evidences.

Hi Tonujax,
I went through the same situation as you, having applied for both EEA3 for my partner and EEA4 for myself.
I would thoroughly recommend you, if possible to apply for the EEA3 first, assuming you have five years. If your application for EEA3 is successful, you can skip Section 7 of the EEA4 and place a tick on it. This might speed up the application for EEA4 if the EEA3 applicant receives PR. As a general rule of thumb, EEA3 applications outcomes are always very fast.
My timeline of my events
EEA3 (EEA ID submitted)
Submitted in Feb 2014. Received five weeks later in Mar 2014.
EEA4 (EEA ID plus non EEA passport submitted)
Submitted in Aug 2014. Received thirteen weeks later in Dec 2014. (This is pretty amazing as my EEA2 took 22 weeks to arrive)

Hi Tonujax,
I had more than 5 years in UK so I applied for EEA3 first. PR was granted for EEA3, so with that PR card, we applied for EEA4 and didn't have to write Section 7 of EEA4. Although we still gave them ALL the documents needed from European National (p60s, letter of contract) when we applied for EEA4.
All our documents , bank statements, utility bills, etc was about 6kg worth? Lol.
My point is with your partner's EEA2 does not expire first, send in EEA3 in five months time when you do qualify. EEA3 is usually within a month or two to receive an outcome.
