FLR FP and partner Pr card ?

Hi i need a help regarding my application which is already with home office .i have applied under private life basis .Now if my application refused would i have appeal rights ? i will explain my previous stay in uk :
came uk on a student visa 2011 ,applied for a extension on 2013 before my leave expires .college revoked during my application with ho then i was given 60 days to produced a new Cas but some how i could not get a cas because my ielts certificate expires with in those 60 days .they refused my application which later i challenge to first tribunal then upper tribunal both did not allow appeal in favor .now my flr fp pending for decision .i have one daughter and my partner who has retained his residence card under eea regulation and he is due for pr very soon probably in 2 months .is there any way i can stay until he obtain his pr .can i challenge ho decision on my pending flr fp in the uk court . does i became overstay in all that previous history ? how i can stay upto my partner obtain his pr ?
