Permanent Residence Card

I am an EEA national and my husband is a non-EEA national. We both have lived in the UK for more than 5 years, since December 2009. We both want to apply for premanent residence. My husband's Residence Card expires in July 20016. Can he apply for his Permanent Residence Card in advance, a year before his previous residence document expires, taking into consideration that he has been living in the UK for 5 years and 7 months?

PR status is automatic and not something that is acquired on application. So, provided he has stayed with you while you exercised treaty rights for five years, he already has PR status.
What will matter for the purpose of PR is not his stay, but yours. Have you successfully exercised treaty rights for five years?

Thank you for your reply. To get Permanent Residence, my husband has to apply for a Permanent Residence Card (EEA PR) when his current Residence Card expires. By our family circumstances, we wolud like to apply this summer, which is a year before his current document expires. Do you think we can apply in advance?
