My friend was on a student visa which was curatiled to expire (college licence revoked) on 09.04.14. She married her Polish national husband on 22.03.14 and applied for a 5yr RC on 31.03.14. Whilst her application for a RC was pending she asked for permission to return home for personal reasons and the Home Office returned her passport. Whislt back home she applied for an EEA family permit to re-enter the UK with her son which was granted for 6 months to expire on 13 Oct 2015.

She was then called for interview and the Home Office confirmed that they had not treated her application as withdrawn despite the fact that she returned home. Unfortunately there were discrepancies at the interview and her application for the 5yr RC was refused and her passport retained. She has lodged an appeal.

We would like to know what her son's status is because he was granted a six month EEA family permit which is yet to expire on 13 Oct 2015.

Is he to be joined to the appeal or is he to apply for a 5 yr RC?
Has my friend's EEA family permit also been revoked?

Does anyone have any idea?

Is there a helpline number on any official letter in connection with this?
Only the caseworker will know the grounds for the action they have taken on this case & who it applies to.

No helpline number and usually they're not very helpful

The family permit is not revoked. Revocation would create a free-standing appeal right which would be notified. Obviously though the EEA family permit is only evidence of, but not proof of, an underlying right. As the parent has appealed that would secure the child's position for the time being, as I see it anyway.

that would be my understanding, they could apply for a residence card themselves and introduce evidence to rebut the inconsistencies in the parents application/interview.

Good morning

The son has now applied for a RC as advised by El Patron and his mother is awaiting a hearing date. In the meantime, her son has to go for biometrics and his mother being his guardian has to accompany him with ID but her passport is with the HO.

Can anyone advise what she can do as time is running out for her son to take his fingerprints.

Mother can use any other form of photo ID she may possess.

If the responsible adult for the applicant under the age of 16 is their parent then the identity documents they need to provide will be:

• biometric enrolment letter
  photo ID

Many thanks for this but they refused all other forms of photo ID including work ID.

Does anyone know how to get around this?
