EEA Family permit

Good afternoon,
I am writing to kindly ask for an advise on me and my husband's case. I am an EEA citizen, Polish, living and working in the UK for almost 4 months now. My husband is non EEA citizen, we lived and got married in Poland. My husband's residency card fnished in march 2015 and we applied. After 7 months of review we recieved a negative decision, justificated by the fact that we don't live together at the moment. We reapealed and don't know how long the process will take again. I wanted to ask, if in our situation my husbnad, who is now still in Poland, can apeal for spouse visa? Can he apply beeing in the EU already but not having residency card in the country where he is applying from?
I would be gratefull for an answer. Thank you

The EU regulations are more favourable to EU nationals & their dependents (compared to UK immigration regulations & a UK spouse visa).

A UK Family Permit would probably be the most suitable route for your case. You do not have to be living together, husband can surely apply for a FP to join you in UK.
