Old AN form - still valid?

Hello all,

Does anyone know if and how long the old application form and old requirements under which EEA citizens did not require a document certifying permanent residence status will be valid for after 12 November?

I do of course realise that 12 November means 12 November but with the amendment having been rushed through parliament and put into force so quickly, the Home Office apparently didn't even have time to announce it properly and in good time in either the guide or the booklet.

I'm in a very difficult situation now, as I printed out the form just before it was amended, unaware of the new requirement, and have now submitted that without a PR certificate (received at Home Office on 17 Nov).

Is there a transitional period in operation, or should/can I withdraw my application - without losing the application fee... :(

Any help would be much appreciated.

My understanding is that there is no transitional period. If you had applied through the NCS they would have refused to submit your application.
Here's a link to cancel an application, but it does advise that you won't get your fee refunded if the application was made in the UK.

Thanks for your reply. As far as I'm aware the application hasn't been processed yet and the fee hasn' t gone off the account. So does that still mean I won't get a refund?

I didn't use the NCS because my application was otherwise very straightforward (permanent employment for last 10 years, no dependants, UK uni degrees etc.).

As mentioned above, it's not clear your fee will be refunded...
You applied in the UK

You need to cancel your application using the online form.

You won’t get your fee refunded if you cancel an application that you made in the UK.
The other option might be to wait & see if HO writes with instructions for this situation - or else (maybe??) returns/refunds your application.

It would be worth applying for your PR now in the hope that if your BC application is refused (it takes 6 months on average to process) you may be able to submit your PR certificate and request a re-consideration. The fee for this would be £80.

Would it be possible just to get the documents returned, leaving the application pending, and then submit the PR certificate once received?
