Hi,
I have been invited to visit my brother abroad in early Feb 2016. I am currently on Temporary EEA Residence Card that will expire in 2017. I am separated from my wife (Slovakian national) but we are still married. we have a son who is 7. At the moment I am currently going through court with regard to my having access rights to my son and final hearing is on 29/01/16. Would I encounter any problems leaving the UK and returning a week later?

Under EU rules, you are still married until legally divorced (with
decree absolute) so your current RC should not have become invalidated (yet).

Thank you. But my question wasn't really about my RC. It was about if I will encounter any problems coming back from abroad if IO started asking questions about my wife and to provide such papers.

My point was the RC should gain your entry back into UK as long as its still valid; (as long as still legally married).
