non-EEA PR-anyone applied with letter rather than the form?

Hi guys,

I was asking as a comment in another really long post and it seems the comment got lost.

I am an EEA qualified person and married my non-EEA wife on March 2011. Her EEA2 Residence card will expire on July 2016 and she has to apply for PR now.

We've got a few doubts:

1. I read that we can apply before the 5y period is completed to gain time, does that mean we could apply already in Jan 2016 (as I was understanding that the 5y period starts counting from our marriage date on March 2011)?

2. Do you know which documents we'll need to send? and as she's a non-EEA person, would we need to send her documents, mine, or both?

3. I was reading here that some people got a biometric letter after applying and then they sent their details. Do you know if we can send the details straight away on the 1st application?

4. I read that EEA(PR) form is not mandatory, ie, that a simple letter asking for the PR should be enough. Has anyone applied this way? And do you have a draft example to have a look?

5. By the way, the PR is a sticker in the passport for a non-EEA person?

1) Wait until you qualify or you will be refused.
As dependent family member (spouse) of EEA national wait until at least 5th wedding anniversary.

2) Read PR guidance (from Gov UK website).
Adequate supporting documentary evidence is vital.

As dependent family member you submit evidence from both parties.

3) Non-EEA person is invited to enrol biometrics. Wait for such a letter after applying.

4) Using the form (or latest form) is not mandatory.

You could apply by writing a cogent letter, include fee, send all evidence.

Another approach some members have used is to apply on an earlier (simpler) version of the PR form.

Regarding this part... I was reading the 1st link you provided above and they mention:
A letter asking for a document to be issued, or an application made on one of the previous
forms (see below) is acceptable, provided the applicant:
 submits the specified fee with the application
 gives their biometric information, if they are a non-EEA national applying on or after 6
April 2015
I read that a non-EEA person could just go to a post office and have that information provided? Shouldn't/couldn't we just go to a post office and have that biometric information beforehand so that it's sent together with the application?

You cannot enroll your biometrics at the Post Office until you get the letter from HO which has a barcode on specific to you and your application. You do not get the 'biometric information', it is sent electronically to HO by the Post Office.

Has anyone seen a draft of a successful letter applying for PR?

I assume it would just need to mention identifying data, arrival date and what the applicant was doing during that time that qualifies them for PR. Along with the £65 fee. Would an EEA citizen need to include anything about biometrics?

EEA nationals do not need to submit biometrics so you can leave that part out,

The only information you should need to provide are:

identification (passport)
proof of exercising treaty rights (for example 5 years of P60's, bank statements etc)
proof of residency (utility bills, tenancy agreement etc)
absences since start of qualifying period

Obviously you can just use the payment page from the form, or write a cheque.

No more should be required, as per the EEA regulations. If I had known now what I did when I applied, I would not have used the form (would have saved me a load on postage too :lol:)

Thanks ohara and noajthan.

I've found some previous versions of EEA3 online. One from 2010 is 12 pages long and by 2014, it was 40 pages long. Would it matter which version? 12 pages is of course more appealing.

Then again, a simple letter seems even more appealing. I assume if they required some missing piece of information, they would write to request it rather than simply rejecting the application via letter (or out of date form).

As long as the old versions of the form ask for the information which is required, they should be fine to use. As you probably know, they cannot reject an application which is made on the wrong/old form, or even without one, providing the correct information is supplied.
