EEA Family Permit Extended Family Member Query

Hi guys,

Was wondering if someone could help me.

I'm an Aussie and I've been in London for the last 2 years on the Tier 5 YMS visa. Since it's coming up to the end of my visa (end of May) I'm looking at how I could possibly stay in the UK as I really don't want to leave my job or life here.

I've been in my job for just over a year, and was going to get sponsored, but unfortunately work came back to me a couple days ago and said they couldn't do it cause my job was not on Level 6 NQF or higher nor on the shortage occupation list - I'm a creative/graphic designer.

I've been researching if there's any other way I could possibly stay and I've come across the EEA Family Permit - more specifically the extended family member option.

Now this is my situation. I have 2 aunties and multiple cousins living in England, and looking at how I could use this family permit to exit England and then come back on it.

Is that possible? I've read that you have to prove that your dependant on them, which I actually am, as my aunty has been giving me money to live in London as I don't make enough at my current job to survive here. What exactly needs to be proven?

If anyone has any information that would be amazing. Happy to provide more info if need be. Just was to exhaust all my options before I have to go home.

And who could blame you.

However, FP is for EEA nationals and family members.
Is your kindly aunty an EEA national? (ie not a BC?)

Thanks for such a quick reply!

Unfortunately not, they are all British citizens.

Does that not work if they are? It says that the EEA includes the UK and the national needs to be in the UK already?

No, except in special circumstances Brits are not regarded by HO as EEA nationals and they cannot act as EEA nationals in the UK.

What are the special circumstances?

Does anyone know if there's any route to staying on with a family member in the UK? If there's family sponsorship or proving that I depend on them etc.

I really want to stay here, and so does my work but can't seem to find any viable options anymore!

Surinder Singh route. You don't appear to have taken this route (with your sponsor) in a.n.other EU country.

McCarthy transitional arrangement - N/A as you weren't in UK with sponsor in/before 2012; (& sponsor would have to be a dual - EEA/British national)

Only option is to study (very expensive) or find a T2 work sponsor (do you have highly desirable skills?) or marriage (drastic).
