Hi all,

i'm a EEA national and my spouse is Sri Lankan. We are living in the UK since 2005.
My spouse had already 2 UK residence cards in the last decade.
Is she now automatically entitled for a permanent residence card?

How long has she physically presented in the UK?

My wife is here in the UK since 11/2005.
She was never more than 30 days out of the country in each year

She is probably entitled, but the residence cards by themselves prove nothing relevant.

She needs to prove that for five continuous years, you were at each moment either a qualified person or a permanent resident. The simplest method would be if you have held a document certifying permanent residence (DCPR) for five years. The next easiest method is probably to show that you were working in full-time employment for five consecutive years.

We can prove that we lived for more than 10 years at the same address together.
In addition i can prove that i'm in full employment for more than 5 years.
Should be a straight forward application process then, right?

You are dealing with HO so don't take anything for granted.
It all depends on meeting the requirements and on the quality of your documentary supporting evidence.

Are you an A8 national?
Do you have a confirmation of PR card?
Any prolonged absences from UK (by you)?

I think in 11 years i have been less than 2 month out of this country.

What do you mean by confirmation of PR card?
I never needed one to live and work here.
It's my wife who wants to apply for a one as she is tired of reapplying every 5 years for a residence card.

Good, so no WRS to worry about.

Your absences are ok.

I didn't say you need a PR card (although if you have ambition for privilege of citizenship you will need one for yourself);
I just asked if you have one as that would simplify the evidence you will need to submit on behalf of your wife.

As you don't have a PR card just make sure you collate & submit good quality evidence to prove all requirements for your family member have been fulfilled.

Payslips from both
Driving licence from both
NHS card from both
Child benefit correspondence
Previous HO correspondence
Marriage certificate

No need to think, just check form and guidance notes.


Also: passports/id; family permit (if any); residence card/s &/or residence certificates

Proof of residing together (tenancy or house documents, utility bills, voter registration (if applicable), council tax bill, tax letters/documents, etc)
A few tasteful photos together;

For sponsor, proof of exercising treaty rights, for example as a worker: P60s, employment contract/s; employer letters (eg about pay rise/promotion), redundancy or termination notice/s (if any) & etc
