Married to an EEA national outside Europe and applying for the EEA Family Permit in the UK
Hi everyone,
I am brazilian and my husband is a dual-national of Spain and Brazil and have 2 different names because of that. They are not so different, but one of the surnames is.
We recently got married in Brazil using his brazilian name in the marriage certificate, but he lives in the UK for 3 years and is there as an EU citizen (Spanish) and we would like to apply for the EEA Family Permit so we can move together
We are using the VAF5 form:

Would the different names be a problem for the application?
Is it necessary to get the marriage recognised by Spain first?

Does he hold any legal document to prove he has changed his name from one to another?

He doesn't have it because this was not really a name change.
In Spain your name is the first name followed by the surname of your father and the surname of your mother, so the country chose his surenames for him.
What he has is 2 passports with the same picture, birth place, birth date and signature. First name is the same, one surename is the same, but both names have one surename of their own.

Names and also passports (that is, the names used on different passports) will need sorting out
before getting to naturalisation and first British passport stages of the journey or it will get messy and complicated.

We just found out that the Spanish Civil Registry document states that he has a 2nd name, so both names appear in the same official document. That should do it, right?
Do you think it's still necessary to get the marriage recognised by Spain first?
