eea family permit to residency card

Hi everyone,
Pls am in dilemma and I need advice , my wife eea family permit has just been issued, after going through appeal with the tribunal
And she is coming to the uk on thursday, my question is if she or I, applied for housing benefit, is it gonna affect her residency card application, as I intend to apply for residency card for her next week.. Am working at the moment, but my wages cant sustain two of us and the rent, though am studying as well here in london.

If a worker you will probably have to pass the HO PET/MET test.
If a student do you have CSI in place for the two of you?

I would apply as a worker, my question is if "me" the eea or "she" non eea apply for housing benefit, wont that affect the residency card application

Maybe.
The more important question is whether HO recognises your work is 'genuine and effective' (EU law) and can pass UK's additional PET/MET test.
Then you can worry about whether any such benefits make you an unreasonable burden on the social assistance system of UK.

So that's a start then.
RC should follow but is not guaranteed; they are issued under different regulations with different criteria.
Why did FP have to go to appeal in first place?
What was area of doubt?

My other question is does having a eea family permit Would make the residency card application easier or it wont make any difference ?

You won't get it rubber stamped.
It may be easier as you have already collated a goodly proportion of supporting evidence and will have practised dealing with UK bureaucracy.

They cited marriage of convenience in Nigeria last year when we applied and the tribunal allowed the appeal this year

That's one of the tests (relationship) in the 4 stage evaluation for RC.
So hopefully you've smashed that one.
