Hi there,
Unfortunately for the second time my EEA application (for permanent residence card) was rejected. They say that the only thing they can give me at this stage is a Registration Certificate. I don't know how useful this could be, but I guess t's better than nothing, I would say. Considering that I already paid my £65, I think it's worth to accept it.

I'm here to kindly ask you to suggest me/recommend me privately (because I know it's not possible to do it here publicly) somebody that could help me in preparing a new application. I would not apply again by myself. This time I need the help of somebody with a strong knowledge on the subject and these kind of applications. Somebody affordable. I know that there's charities with fresh lawyers available to help for very cheap or even nothing. Some organisations of this type that could help me prepare the next application or even advise me against if they think I have no hope of success.

You don't need a solicitor to help you with PR application.

How did you mess it up?

I know that I don't need a solicitor but because I failed twice, I don't wanna take the risk again, if I will ever be confident to apply again.

My case worker says that every jobseeker period after 3 months, resets the start date. So basically I've lost more than 5 years living in this country. Back in the days, being a jobseeker was considered being a qualified person, now apparently it's not.

I wonder if I could present my self (in those periods where I was a jobseeker) as a self sufficient person because my parents were always there when I was struggling financially. That's the reason why I need some advise by an expert. I need to see if I can present myself in other ways in order to qualify.

I know people who are from countries outside the EU, have been working without contract, getting paid cash in hand (and so there is no proof for that) and got the British passport. How did they manage to achieve that?

It seems the OP was a jobseeker for four consecutive years (2011 to 2014).

Just to clarify, the original 2006 Regulations (i.e. made in 2006) state that a person who had worked in the UK and was made involuntarily redundant would be treated as a worker if

Regulation 6(2)(b) as made

(i)he was employed for one year or more before becoming unemployed;
(ii)he has been unemployed for no more than six months; or
(iii)he can provide evidence that he is seeking employment in the United Kingdom and has a genuine chance of being engaged;

(ii) has not been met as the OP has been unemployed for four years.

What evidence does he have of meeting (iii) i.e. of having a "genuine chance of being engaged", especially given that he was unemployed for four years?

Don't confuse the EU Route with that that non-EU migrants follow, i.e. UK Immigration route. Unlike EU citizens, non-EU migrants have many different avenues/routes/visas to ILR and citizenship and their working rights do not come from 'exercising treaty rights' or being a 'qualified person'.

Getting settled status under EU rules is a walk in the park compared to the UK immigration routes.

Don't be too hard on yourself. It may just be that you have not acquired PR yet.
To qualify as selfsufficent you would need to show you were reliant on independent means (not benefits) and had CSI in place.

Otherwise take the RC.
Whatever you do now you probably don't have time to acquire PR in the normal way as your PR clock started as a worker in 2015.
Any EU-related document you do have may help if transitional arrangements are brought in for all those citizens still 'in flight' on the final Brexit exit day.

When I was a jobseeker at the time, according to the rules in those days, I was a qualified person. If they change the rules and backdate them, it's totally unfair.

It's obvious that getting permanent residence and then the British passport, gives me more guarantees as a human being in this country. Not having such documentation and having to wait for other 4-5 years puts me in a situation of total uncertainty that I'm not sure if I'm willing to face at this stage. And who knows if I lose my job and end up being unemployed again for a certain period. Then we start all over again?

Obviously the majority of the British people and the Government can only be happy if somebody like me, and many others decide to give up and go somewhere else.

When you were a jobseeker at the time, according to the rules in those days, you were a qualified person for six months after you were involuntarily made redundant.

After those six months, you need evidence of "having a genuine chance of being engaged". Otherwise you cease being a qualified person under the rules as from 2006 onwards.

There is no backdating of the rules. Those were the rules in place at the time.
