Apply Zambrano on behalf of real uncle who is BritishCitizen

Hi

I came to UK 1993 and sought asylum. I went back to Pakistan in 2004 and came back with in four month.

My application for asylum get refused in 2102

Then I applied for leave to remain under EEA (FM) in connection with Zambrano case law was refused with no right of appeal.

I applied for EEA card as a primary carer of a British citizen on 11-09-2015 which was refused on 28-04-2016.

In the absence of a right of appeal in that instance I seeks permission to judicially review the decision of Home Office which was determined on 28-04-2016.

My real uncle has been diagnosed with diabetic neuropathy and some other pathological condition and which forbid him to take care of himself.

I am living with him for last 20 years same address.

Home office raised an issue on derivative right as I don't have valid Pakistani passport.

I have sent them National ID card of Pakistan and ARC asylum card.

I have also applied for guardian permission on behalf of my uncle.

I need a professional suggestion on my current immigration situation.

Where does he EEA element come into anything? I only see reference to Pakistan and Britain?

The EU is not a bunch of Philistines.
The Zambrano judgment established that member states cannot refuse a person the right to reside and work in the host member state, where:
that person is the primary carer of a Union citizen who is residing in their member state of nationality;
