Valid Identity of your sponsor EEA-EFM

Hi everyone,
I found this forum very informative and supportive in all aspects. I have applied as an EEA-EFM just before referendum. I belong to non EU states. My sponsor is a Swedish National . Due to some unavoidable circumstances I couldn't send his passport along with my application. I sent his original Swedish driving licence as it could be used as an ID with all other original documents. Later, I received short style COA, explaining we cannot confirm your right of work until decision is made and further explained in bold letter this because you are the Extend Family Member or unmarried partner. But the most concerning point which they wrote separately that you have also not provided original documentation for all of the following:
1. valid identity of sponsor.
My solicitor then sent a coloured passport copy while attesting himself and request for work permission. Now I received a second COA explaining,
We cannot confirm it until the outcome of your application. They further explained this is because, you have not provided original documentation for all of the following:
1. Evidence of relationship
2. identity
3. Treaty Rights
Or
You are an extended family member/unmarried partner etc
I am only confused about the valid identity point which they mentioned in my first COA. while in second COA they add further information like treaty rights, relationship etc. In my first COA they attached a questions and answers sheet that why are we unable to confirm your right to work. There were two answers,
1. Because of EFM/Unmarried partner
2. Not satisfactory evidence of identity/relationship. we will consider your application but may contact you for some additional or alternative evidence
My question is,
Can HO refuse my application on the basis of valid identity or will theyl contact me for further evidence. what shall I do?
