Danish national - Pakistani brother - EEA permit

Hi,

My brother is Danish national and lives in Denmark.

My other brother is Pakistani and lives in Pakistan.

We're planning to apply for EEA permit. My Danish brother is sending money to my Pakistani brother for over an year from Denmark and got all documented evidences.

My Danish brother came to UK and worked for three months and went back to Denmark. According to immigration gov.uk website they can apply without my Danish brother coming to UK.

Is there any chance? What further documentation is needed?

Thanks in advance.

Which brother is going where with which other brother?

Noone can come to UK with Danish brother as sponsor if Danish one is elsewhere! Its move with or join.

Thanks for the reply noajthan.

Perhaps I could't ask my question properly.

According to your reply what I understand is:

My Danish brother has to go to Pakistan and apply for my Pakistani brother's EEA permit from Pakistan so they can move to UK together.

OR

My Danish brother have to move to UK and exercise treaty rights. After 3 or 6 months (not sure) my Pakistani brother apply for EEA permit from Pakistan to join my Danish brother in UK.

Am I correct?

Brother can get a Schengen and go to Denmark.

Or Danish brother can return to UK and brother can apply for a FP to travel with or join Danish brother in UK.
Proof of dependency required.

To stay more than 3 months in UK, Danish brother needs to be exercising treaty rights at or before end of 3 months.

If Danish brother is Danish he'll need to exercise a treaty right won't he? If he's Danish and British then it doesn't work at all does it?

Intrigued as to how he became Danish, not one of the easy ones to get - nine years.....

Hi Wanderer,

Danish brother moved to Denmark in 1999 so that's why he is Danish :)

Yes! He'll move to UK and exercise treaty rights. As noajthan mentioned that Pakistani brother can get Schengen visa and they both can apply for EEA permit from Denmark, I think it'll not be easy to get Schengen visa from Pakistan.
