Hi - I am about to send my PR application. Please could you shed some light on my situation, I have provided

• Year 1: Complicated situation, not sure it will count in the 'PR clock'
• Years 2 to 6: Straightforward situation, it will 99% count in the 'PR clock'

My questions are:
1) If Year 1 is NOT counted towards the 'PR Clock', will my application be rejected OR will I receive the PR with effective date being from Year 6?

2) If Year 1 IS counted in the 'PR Clock', will the effective date of the PR be Year 5 or Year 6?

3) I understand this 'effective date' is not shown in the PR card nor in the letter. How can I find it quickly so that I can assess whether I can apply for citizenship?

1) It won't be rejected, as long as you do have a continuous 5 year period of exercising treaty rights. It doesn't matter when this period is. What is complicated about year 1?

2) HO will try to determine the date you first acquired PR, so if year 1 is counted, your PR date will obviously be in year 5. They generally know what they are doing though, and if you weren't a qualified person in year 1, they will ignore it.

3) Two ways to find out your PR date. First is to submit a subject access request (SAR) to UKVI asking for the data they hold on you. This is the cheapest way (either £10 or free) but can take a long time, perhaps 6 weeks or more. The other way is to book an NCS appointment to submit a citizenship application. The adviser can find out the date on their telephone hotline to UKVI. This is obviously the much faster way but much more expensive (£60+ depending on council).
