Hi,

I am in the process of filling in the application for permanent residency, using the new online application service.I am applying on the grounds of 5 years continuous residency in the UK.

I entered the UK as a student in 1996, and remained a student till 2001 when i got my first job. But i have been working pretty much ever since.

To the question: "Have you been a student or done vocational training since entering the UK?" then I have to answer YES.

I understand my application is on the grounds of the 5 more recent years ie 2011-2016, during which i have been in Full time employment except for 7 months of job hunting in 2014. I have overall over 15 years work experience in the UK.

Yet i have to declare that i will provide evidence of "comprehensive sickness insurance" for the period i was a student, even though that was 20 years ago, and far out from the current 5 year qualifying period? I am not asked to provide such evidence for the time i was unemployed.

Is this correct? Has anyone come across this?
You want to present truthful information, but they don't ask you if you have been a student in the last 5 years that is the qualifying period. They ask you if you have been a student since entered the UK. So you have to say YES, then they ask you to declare you will provide the documents.

Can anyone offer any advise on this? Do we still need to provide documents like that for our status far away from the qualifying period?

PR is acquired by exercise of treaty rights, continuously, for 5 years not simply by 5 years residency.
Students must have had CSI (or alternative) in place during carefree student years for such a period to count towards acquiring PR.

If you have worked sinc 2001 you may have acquired PR as early as 2006. Its not all about the "last 5 years".

You will notice there there is no question on the form such as what is your qualifying period.
Simply complete the form and provide the various timelines requested; the caseworker will assess the information (& supporting evidence) to determine if she can confirm you have acquired PR.

Thanks for the clarification. The documents for the comprehensive sickness insurance are not in the mandatory section. So i hope that, if i cannot provide them, since i have another 15 years of employment and P60s, my application will not be rejected on the basis of those first 5 years as a student.

No, it should not be if you have an alternate qualifying period - and good supporting documentation to back it up.
