ilr after 5 years marriage with eea national possible route?

hi

one of my friend called ukba to get info about ilr after 5 years of marriage and they told him that those people who don't get visa because of some reason and there application is rejected but there marriage is 5 year they can apply for ilr.

is is true? I married in 5 years ago but haven't got the visa. applied 2 time both time rejected because they believe employment isn't genuine and relationship is fake.
but we have a child now and married for almost 5 years. my court hearing is in march and in april our marriage will be 5 years so is there any option for me?

I think your friend either misunderstood or the UKVI 'help line' was giving their usual incorrect advice. :!:

The UKBA was disbanded in March 2013 due to being 'unfit for purpose'.
