EEA Family Member - PR issue - Please help

Dear All,

I married A European girl in UK on 02/11/2011 and granted EEA family member residence permit on 10/01/2012 for 5 years

On Feb 2015 we started the divorce process, I received the final divorce paper on July 2015.

On Jan 2016 I married again to another European girl in Spain and we did register our marriage in Spain but both of us live and work in UK

My ex-wife was living and working in UK since 2008
I work and living in UK since 2008
My wife work and living in UK since 2015

Non of us applied for any kind of benefit at all

My questions are the following:

Can I apply for PR or I need to apply for retain my right first then PR ? I got confused between solicitors

One solicitor advised to apply for PR put my ex-wife P60, my Payslip and my wife payslip with old and new marriage certificate.

But again other solicitor didn't recommended


2. Do I have to do any special process because I married divorced (waited nearly 6 months ) and then got married again ?

3. For my ex-wife I have all her original P60 for 2011, 2012, 2013 and 2014 is that enough or I need any other document

EEA FM Payment not taken after 4 weeks

Hi,

I have applied for an EEA FM Residence card on 09/11/2016.

This was received on 10/11/2016 according to royal mail but the payment hasn't been taken yet.

I have emailed them and called them. Someone returned my call on the following day explaining that they can't tell me anything about the application as it is initially sent to the Durham office to process the payment then it is sent to them.

This is not acceptable after 4 weeks and the advice I was given was to contact my bank or check my credit card statement.

I am worried as I want to request my passport back and looking forward to receive biometric letter and COA.

Any advice on how to escalate this?

Also a quick question can I request my passport back now or shall i wait for the Biometric Letter or the COA?

Don't expect too much mollycoddling or feedback from HO.

There is no payment SLA mandated in EU law.
Followup queries not entertained until 6 month mark; call centre staff can't track your case and calling earlier just clogs up switchboard.

There's ways and means to escalate but much too early for that at this stage.

HO may or may not return docs, suggest give it a few weeks.

Pro tip: If EEA you could have used the new council service to certify key docs.
