Kareem overturned proxy marriage recognised

The Home Office has made a concession before the Court of Appeal that Kareem was wrongly decided.

In the case of Awuku .

Those who have had their appeals or application refused, should focus on this case and it's outcome.

Unlike in Sala where the Upper Tribunal asked that a friend of court be provided to deal with the contrary argument. The court of appeal asked for one to put both argument.

Those whose appeal hAve been dismissed on the basis that there is no evidence that the EU citizen''s state accept proxy marriage should focus on this and seek adjournment.

I have always thought that Kareem is not a good law, good that Home Office has finally seen that.

Your guess is as good as mine. All i can say is that Home Office has conceded that Kareem was not correctly decided, and for once i am in agreement with Home Office on that.

Kareem was so ridiculous, that no reasonable judges who focus their mind on the issues raised, would have come up with such decision.

Nice point Obi.. am just wondering how the home office will decide any application on Proxy after this consesion and those on appeal that never been heard

Ohh I get you, if u read through the that post you wil see that I said when i was going through the new guidance and I saw that home office still using Kareem Law while I read about cudjoe

Kareem and TA has finally been set aside. They are no longer good law and must not be followed by the FTT and the UT.

The Upper Tribunal ruled against again, losing its credibility everyday.


Awuku v Secretary of State for the Home Department [2017] EWCA Civ 178 (23 March 2017) has essential reinstated NA(Ghana) and CB(Brazil)

Common sense has prevailed.
