EEA2 evidence of living together

Hi,

we are about to send an EEA2 application (residence card) and we're wondering how to document living together.

My spouse (non-EEA) has just moved in with me (EEA citizen) and we haven't lived together previously.

So far she has two of the documents listed below confirming her address, a phone bill and a GP registration letter. Is that enough, or does she need a third one?

In the guidances it says
6 items, from 3 different sources
. Can I as the sponsor provide the the remaining 4 items?

Or should we instead provide pictures and evidence of how we kept in touch before she moved in with me?

If you and your sponsor are living together, or have previously lived together, please provide evidence of this. We recommend that you send at least 6 items, from 3 different sources. These can be addressed to you jointly or individually, provided they clearly show that you live, or have lived, at the same address.
If you and your sponsor are, or have been, living with relatives or friends, and you do not have any bills or other documents addressed to you, please provide a letter from the relative(s) and/or friend(s) confirming you are/have been living with them.

If you have not been living together (but you’re still married or in a civil partnership), tell us the reasons for this and whether you stayed in contact with each other during this time (see questions 5.9 to 5.10 of the application form), and provide any relevant supporting evidence.
Suitable evidence includes (but is not limited to):
  • -  Letters or other documents from government departments or agencies, for example HM Revenue and Customs, Department for Work and Pensions, DVLA, TV Licensing
    -  Letters or other documents from your GP, a hospital or other local health service about medical treatments, appointments, home visits or other medical matters
    - Bank statements/letters
    - Building society savings books/letters
    - Council tax bills or statements
    - Electricity and/or gas bills or statements
    -  Water rates bills or statements
    -  Mortgage statements/agreement
    -  Tenancy agreement(s)
    -  Telephone bills or statements
    -  Photographs of you and your sponsor together – for example, on holiday or at a family
    celebration
    -  Evidence of how you have kept in contact with each other during periods in which you have not
    lived together –
    for example, letters, printouts of emails or contact via social media, mobile
    phone bills showing you have contacted each other, printouts of Skype (or similar) logs, etc
    -  Any other relevant evidence

Have you been in a relationship 'akin to marriage' for at least 2 years?
Can you prove it?

Can you justify or explain to caseworker the reasons for not living together in earlier months of the 2 years?

because we have just gotten married 6 months ago and my spouse didn't have visa? We supplied tons of evidence (photos, chat logs) for the EEA Family permit, should we do this again?

Apologies, my misunderstanding.

With reference to living together I had thought you were on unmarried route.

You simply have to demonstrate residence in UK. Joint residence helps your case.
Cohabitation is not required under EU law but UK caseworkers tend to look for evidence of this anyway (despite EU law).

- phone bill (her name)
- GP registration (her name)
- Electricity bill (my name)
- water bill (my name)
- council tax bill (my name)
- bank statement (my name)

Is that sufficient to prove cohabitation?

Got any more in partner's name?
Anything in joint names?

Suggest add a couple more items into the mix in case caseworker decides to disregard something.

nothing. She could open a bank account, or I could assign another bill to her.

Suggest you gear up to start generating these papertrails - and you'll need more in future.
Oh and start cultivating potential referees too.

Forget life in the Cloud, when dealing with HO on immigration matters even Millennials need rock-solid evidence and that means paper, lots of paper.

Could your wife have a RC finally? I have the same situation. We couldnt submit 6 items as required, now we are waiting for the result :-s
