Sheffield Visa Section - EEA FAMILY PERMIT

Hi everyone,

It's the third time that I apply for an EEA FAMILY PERMIT. I would like to explain you my situation and the previous refused applications.

1. They have refused the first time because I didn't provided any information about our relationship, I only gave them his payslips and our certificate marriage translated from Spanish to English. - They refused because they have considered that it was a marriage of convenience.
2. I have attached them all our marriage, engagement, couple travel photos- Conversations via whatsapp;Imessage; Facetime; Skype; Facebook. My situation as student of a International master; his payslips; his tenancy agreement; reference letter from a British childhood's friend; reference letter from my last employer.- They refused because the considered that my husband was not exercising his rights in UK.
3. I have applied again with all the following documents: (bellow)
  • Information about me:

    Printed and signed VAF5 application form
    My Passport
    My Passport size picture
    My original Spanish marriage certificate with its English translation (evidence of my marital status)
    Copy of my previous passport (to show my travel history)
    Copy of my current passport
    Certified copy of my ID card (Permanent residence card: as evidence of my permission to be in the country where I am applying)
    Reference letter from my last employer.
    Study certificate from ***********

    Information about my sponsor in the UK:
    Proof that my husband is exercising his treaty rights in the UK:

    Copy of my husband’s Passport (evidence of my husband nationality)
    Certified copy of my husband’s ID card
    My husband’s contract of employment
    My husband’s personal tax returns (recent document from the UK government tax office confirming my husband’s income and the amount of tax that he has paid)
    My husband’s payslips (covering up to the previous 8 months)
    My husband’s National Insurance Number (NIN certificate and a copy of the national insurance number card)
    My husband’s bank statements (showing what has been paid in and out of his account for up to the previous 8 months; the payments of the salary are shown)
    Tenancy agreement of my husband
    Proof of address: (bank statements; tenancy agreement; payslips; Income tax; contract of employment)
    Evidence of the relationship with my husband and any contact between us: Phone records done by my mobile: ******* to my husband’s number: ******
    Print screens of our connection via email
    Print screens of my husband and I conversations via: Facebook, Skype, WhatsApp, FaceTime, Imessage.
    Pictures of my husband and I, including proposal ceremony and wedding ceremony.
    Train tickets confirming that we travelled in Spain together
    My husband’s flights coming to Spain to see me
    Reference letter from my friend ********
    Declaration of our story together
    Declaration from my husband that I will be joining him in the UK and he will be supporting me financially once there.

I have applied on 15th February; On 16th February they have sent me this e-mail:

"Dear *******

Regarding Visa Application: *****
For: *****

Your online application has been received in Sheffield, UK. Your application is currently being prepared for consideration by an Entry Clearance Officer.
"

Is it normal that my application be studied by Sheffield?

I had no news till 1 March when they sent me this e-mail:

"Thank you for applying for a UK visa. Your visa application has been received and is under consideration. We aim to process non settlement applications within 15 working days (unless you have opted for the Priority Visa service), and settlement applications within 60 working days.

Unfortunately, the processing of your application has not been straightforward and we will be unable to decide your application within our customer service targets. We are continuing to work on your application and aim to make a decision as soon as possible.
"

On 12th March I have called them and an advisor told me that my application was in process.
I would like to know if there's someone who has had the same experience?
Could they take more than 1 month of working days processing the visa?
Do you think that my supporting documents would satisfy them? Are they completed?
I feel frustrated because I have been trying so many times waiting for an approval answer and now I have to wait more time. I would like to know if is it a normal situation? I would like to know if the processing time that they are taking is a good or bad news? Because I think that I have submitted more than enough information.


PLEASE HELP ME. I need more than hope. Everything depends on that.

did you apply for the family permit outside of the UK? If so, from where?

Yes, from Spain.

I guess it is to do with the whole BREXIT chaos that is currently erupting, so things MAY get delayed. But that is just a mild guess! It could be anything. :roll:

Just hope for the best and keep waiting. I hope you get excellent news!


I am also currently awaiting results regarding our application form for my hubby.

Today I had a missed call from them, I tried to call but the number doesn't exist. I wrote them an e-mail through gov.uk(outside uk). I don't know if they could refuse me the visa because of that; will they call me again? Because it was only one call at 10:22 am today. If someone know something about this please inform me!

I AM SO NERVIOUS AND AFRAID.

Wait for the email you have sent. They need to tell the person beforehand when they will call, can't just simply call them out of the blue!


Did they manage to call you again?

No, they didn't call again. The email said that I have to wait till decision because it was delayed. :cry: So fingers crossed, and hope in God that's all I have...

Hi Kaoumani, I have same situation like you. I applied twice they refused. I appeal the decision and now they over turned the decision. I have to wait till the call letter from visa office. It is all about Brexit, Home office deliberately delay, harass EEA family permit. If you submit all the papers no matter how many time you apply for new visa they keep refusing you. Cheers mate!! this is not the end of the Road dont be frustrated. I have also have family I live in UK but cant bring my kids and wife. Coz my wife is NON.EEA passport holder but kids are Spanish. So Home office denied my wife visa so My family no longer can come to UK , I have to go back to spain if they dont issue the Visa. This is reality. No matter how much you Earned, no matter your marriage is legal, it is just deliberate and Instructed to harassment of EEA citizen. Sorry!

Hello, I haven't received any reply yet. I have just to be patient, if they refuse I will appeal. Nobody can bring out your rigths to be where you wanna belong. Just don't stop fighthing for what you want. Everything will be okay at the end. They can't take decision about Brexit, the rules are the rules until 2 years...

Just thought I would update regarding my situation!

Hubby finally recieved his passport on the 10th of April. They issued the EEA FP to him on the 5th of April (Thank God!) :D Phew! All that stress was defo worth it.


I would say just keep on waiting because with us they did not even contact us with regards to anything to do with the application form. We just kept on waiting - a sickening wait! :?


If you have sumbitted everything they have asked for and haven't, including financials you will be in a better situation. We included just about everything!

I hope you guys recieve happy news!

I am in the same situation. My husband's visa got refused once within days despite we providing enough information about our relationship. They said pictures were not dated so there's nothing to prove its authenticity.

Applied second time with more evidence and it's been about 3 weeks and haven't received anything back yet - just that email saying application is not straightforward!

So yea - Hehahaha - your news gives me some hope. Could you post your timeline please to give me an idea.

Sure!

Here is my timeline:

Date submitted: 20th March
Biometrics taken: 20th March
UK Recieved application: 20th of March at the Visa Application centre in Sheffield.
EEA PR recieved: 5th April
Passport recieved: 10th of April.

For us, it was the first time applying. So all in all, it took 3 weeks!


All hope still remains! Keep contacting them with regards to information.

Thanks! Yea our processed reached Sheffield on the 21st March - so your case gives me some hope!

Just one more thing - what's the best way to contact them? Are they good in getting back to you?

Date applied : 3/4/17

Got an email saying application is not straightforward on
20/4/17

No luck till now

My first application was rejected on the ground of Marriage of Convenience. I have applied again on 03/04/17 and on 20/04/17 received an email saying my application is not straight forward. I am also eagerly waiting.

Got an email after enquiry

have tracked the status (GWF and date of birth) and
found that a decision on your application has been delayed whilst further
enquiries are being conducted. Your visa application centre or the entry
clearance officer will contact you once a decision has been made or, if
necessary, during the consideration of your application.

4 months is really really long time. You should contact them and ask the status of your application/s.

4 months is really really long time. You should contact them and ask the status of your application/s.
