Urgent help

Hello,
I am a spouse of eea member from last 3.7 years but we are not living together since Jan 2016 as my spouse wants to take a break from relationship. I never applied for a resident card as there was an appeal pending. The place I use to work run ECS Check on me every year which comes out positive. In November immigration officer came to my house for enquiry turns out my appeal was long suspended. They gave me temporary visa for now.
My question is :
Am I eligible for eea residence card?

I have all documents of living together.

Provided your spouse is
a) a non-UK EEA member
b) exercising treaty rights in the UK
c) living in the UK (not necessarily in the same house or even the same city as you);
you have a right to reside in the UK.

It is recommended that you get a Residence Card. You will need proof of your EEA citizen spouse exercising treaty rights in the UK.
