Dear Forum Memebres,
My friend who is a Portuguese national has got EEA family permit refused for his wife and son. She had applied along with her son in Visa Center Islamabad Pakistan.
His wife and son was refused the visa for not being able to provide any other evidence for their relatioship with EEU national. His wife a took a photo album full of the pictures of their family with EU National along with their Son but the lady in Visa centre refuse to take it and said that no need of these things. They have also provided them with Marriage certificate attested from Pakistan and Portuguese embassy they have also attached their son's birth certificate and National I.D cards. What else they can provide??? what other things need to be provided.

Would it be better for them to reapply (When they can reapply?) or should they go for appeal??? Please note that the total time taken to decide their applications was 10 days.

Followings are reasons for refusal.

You have stated that you propose to join your husband ********** in the U.K Who is Portuguese National. You stated that you 1st met on **June 2013, your relation began on ** june2013 and you married on ** june 2013 in pakistan,In support of your application you have provided your marriage certificate.You have provided no other evidence to demonstrate your marriage took place.

You have also provided some money transfer, however you have provided no evidence that would demonstrate that you have met your sponsor. You have stated that you meet your sponsor when he visits pakistan, however the evidence provided only shows he has visited pakistan in April 2016.I am therefore not satisfied that you have provided sufficient evidence to demonstrate all the different stages of your relationship and the time you stated you have met your sponsor. You also stated that you keep in touch with your sponsor through phone calls but you have provided no evidence for it.

I noted you have a child with your sponsor . You have provided no documents that would demonstrate the parentage of the child.

Please have a look at this and discuss it according to your knowledge.

There shouldn't be any problem in this because coming from a conservative Pashtun back ground arrange marriage is part of tradition. This was an arranged marriage where the groom see his bride on the day of their wedding and start living together from the same day and onward. do u have any more questions????

But the biggest problem, in a nutshell is this:

The problem is not that is an arranged marriage (although that is far from ideal in this type of applications). The problem is that, on top of weak evidence of meeting sponsor, there is no evidence of progression in the relationship after the marriage; which to any case worker would look suspicious.

How old is the son?

Then your friend needs to prove he was in Pakistan with his wife at the beginning of 2014. Since they had only provided proof he visited Pakistan as late as 2016, it doesn't really hold in the eyes of the case worker.
