My partner has a EEA FP but expiring the next week. Which is the last day that she can apply for an EEA EFM?

Is the expiring day of the FP the last day that she can apply?

What happens until she gets the EFM Residence card? Does she get a letter that her application is under consideration?

It is important that she applies ASAP, otherwise she will lost the right under Regulation 7(3), and hence the right to work or accept offer of employment.

if she applies today with 5 only days left of her FP, can she still be in the UK legally?

How we will know that the HO received her application and have that as a proof?

Will she get a letter that confirms that she is here legally ?

Why did you live it till the last minute.

Is she working in the UK? Is there further evidence of a durable relationship since she arrived?

She was focused on finding a job.

No she is not working yet.

Yes we have been living together in the UK for more than 2 years, same house, same bills etc.

So her 5 years has expired or her 6 months?

No she was on student visa for 1 year then working on a tier visa and then another FP, but her grandfather died she had to go back before she applied for the RC the first time and now she was just focusing on jobs.

would you thing that it will be better to do a civil partnership quickly so she will be considered as a FM, hence no need to have a RC until the RC will arrive?

You need to send the application, and a COA with right to work will be granted.
